If we experience a security breach affecting your personal information, we will notify you, and where required the Colorado Attorney General, in accordance with section 6-1-716 of the Colorado Revised Statutes.
How long we retain your personal information depends on different factors, such as whether we need the information to maintain your account, to provide the Services, comply with legal obligations, resolve disputes or enforce other applicable contracts and policies.
Your Rights and Choices
Depending on where you live, you may have some or all of the rights listed below in relation to your personal information. However, these rights are not absolute, may apply only in certain circumstances and, in certain cases, we may decline your request as permitted by law.
If you are a Colorado resident, the rights described below are available to you under the Colorado Privacy Act and we will honor them in accordance with that law and the rules issued under it at 4 CCR 904-3.
- Right to Access / Know. You may have a right to request access to personal information that we hold about you, including details relating to the ways in which we use and share your information.
- Right to Delete. You may have a right to request that we delete personal information we maintain about you.
- Right to Correct. You may have a right to request that we correct inaccurate personal information we maintain about you.
- Right of Portability. You may have a right to receive a copy of the personal information we hold about you and to request that we transfer it to a third party, in certain circumstances and with certain exceptions.
- Right to Opt out of Sale or Sharing or Targeted Advertising. You may have a right to direct us not to "sell" or "share" your personal information or to opt out of the processing of your personal information for purposes considered to be "targeted advertising", as defined in applicable privacy laws. You may exercise this right at any time through the “Your Privacy Choices” link in the footer of our Site or by contacting us using the details below. We also recognize and honor universal opt-out mechanisms that have been approved by the Colorado Attorney General, including the Global Privacy Control (GPC). If you visit our Site with GPC or another approved universal opt-out mechanism enabled, we will treat that signal as a valid request to opt out of the sale of your personal data and of processing for targeted advertising, without requiring you to take any further step and without requiring you to create an account. Because the signal is sent by your browser, it applies only to the browser and device you are using, so you will need to enable it separately on each browser and device. We will act on an opt-out request as soon as reasonably possible and no later than fifteen (15) days after we receive it.
- Right to Limit and/or Opt out of Use and Disclosure of Sensitive Personal Information. You may have a right to direct us to limit our use and/or disclosure of sensitive personal information to only what is necessary to perform the Services or provide the goods reasonably expected by an average individual. If you are a Colorado resident, we will not process your sensitive data at all, and will not sell it, unless we have first obtained your consent, and you may withdraw that consent at any time. Withdrawing consent will be at least as easy as giving it, and we will stop the relevant processing within fifteen (15) days of your request.
- Restriction of Processing: You may have the right to ask us to stop or restrict our processing of personal information.
- Withdrawal of Consent: Where we rely on consent to process your personal information, you may have the right to withdraw this consent.
- Appeal: You may have a right to appeal our decision if we decline to process your request. You can reply directly to our written denial or email us at elizabeth@buffbo.com with the subject line “Privacy Rights Appeal”. The appeal process is free of charge and is as easy to use as the process for submitting your original request. We will inform you in writing of the action taken or not taken, together with our reasons, within forty-five (45) days of receiving your appeal. If we deny your appeal, we will provide you with a method by which you may contact the Colorado Attorney General to submit a complaint; you may also do so directly at coag.gov/file-complaint or by calling 800-222-4444.
- Managing Communication Preferences: We may send you promotional emails, and you may opt out of receiving these at any time by using the unsubscribe option displayed in our emails to you. If you opt out, we may still send you non-promotional emails, such as those about your account or orders that you have made. You may opt out of marketing text messages at any time as described in the Mobile Terms of Service section below, and we will honor an opt-out request made by any reasonable means.
You may exercise any of these rights where indicated on our Site or by contacting us using the contact details provided below.
We will not discriminate against you for exercising any of these rights. We may need to collect information from you to verify your identity, such as your email address or account information, before providing a substantive response to the request. In accordance with applicable laws, You may designate an authorized agent to make requests on your behalf to exercise your rights. Before accepting such a request from an agent, we will require that the agent provide proof you have authorized them to act on your behalf, and we may need you to verify your identity directly with us. We will respond to your request without undue delay and in any event within forty-five (45) days of receipt. Where reasonably necessary, we may extend that period once by a further forty-five (45) days, in which case we will tell you about the extension and the reason for it within the first forty-five days. If we decline to act on your request, we will tell you why and explain how you may appeal.
We use Shopify's ad services such as Shopify Audiences to help personalize the advertising you see on third party websites. To restrict Shopify merchants that use these ad services from using your personal information for such services, visit https://privacy.shopify.com/en.
Complaints
If you have complaints about how we process your personal information, please contact us using the contact details provided below. If you are not satisfied with our response to your complaint, depending on where you live you may have the right to appeal our decision by contacting us using the contact details set out below, or lodge your complaint with your local data protection authority. If you are a Colorado resident, you may also submit a complaint to the Colorado Attorney General’s Office at coag.gov/file-complaint or by calling 800-222-4444.
International Users
Please note that we may transfer, store and process your personal information outside the country you live in, including the United States. Your personal information is also processed by staff and third party service providers and partners in these countries.
If we transfer your personal information out of Europe, we will rely on recognized transfer mechanisms like the European Commission's Standard Contractual Clauses, or any equivalent contracts issued by the relevant competent authority of the UK, as relevant, unless the data transfer is to a country that has been determined to provide an adequate level of protection.
Mobile Terms of Service
The Buff Bo Outfitters mobile message service (the "Service") is operated by Buff Bo Outfitters (“Buff Bo Outfitters”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features. To the extent permitted by applicable law, we may also modify these Mobile Terms; we will notify you of any material change by text message or email before the change takes effect, and you may opt out of the Service at any time if you do not agree to it. These Mobile Terms supplement, and do not replace, the rest of this Privacy Policy, and nothing in them limits any right you have under the Colorado Privacy Act, the Colorado Consumer Protection Act or the Telephone Consumer Protection Act.
You must be at least eighteen (18) years old, and you must be the subscriber to, or the customary user of, the mobile number you give us, in order to enroll in the Service. We do not knowingly enroll anyone under eighteen (18) in our promotional messaging program, and we do not process the personal data of anyone we know, or willfully disregard, to be a minor for targeted advertising or for the sale of personal data without the consent required by the Colorado Privacy Act. If you believe a minor has been enrolled in the Service, please contact us at elizabeth@buffbo.com and we will remove the number.
By consenting to Buff Bo Outfitters’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Buff Bo Outfitters through your wireless provider to the mobile number you provided, We will send you promotional text messages only where you have given prior express written consent to receive them, and service-related text messages only where you have given prior express consent. Because you have given us that prior express invitation or permission, these messages are not “telephone solicitations” under the Colorado No-Call List Act, section 6-1-903(10)(b)(I) of the Colorado Revised Statutes. If you withdraw your consent we will stop sending them, and we will not send you telephone solicitations if your number appears on the Colorado no-call list or the National Do Not Call Registry.
Text messages may be sent using an automatic telephone dialing system or other technology. Every message will identify Buff Bo Outfitters as the sender and will come from a number that displays on caller identification services; we do not block or circumvent those services, as required by sections 6-1-702 and 6-1-904 of the Colorado Revised Statutes. We send text messages only between 8:00 a.m. and 9:00 p.m. in your local time zone. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).
We use the mobile number you give us, and information about how you interact with our text messages, only in order to operate the Service, send you the messages described above, provide customer support, and keep the records of your consent that the law requires us to keep. We do not sell, rent, or share your mobile number, or the fact that you have consented to receive text messages, with any third party for that third party’s own marketing purposes, and the categories of personal data that we “sell” or “share” as described earlier in this Privacy Policy do not include mobile numbers collected for the Service. We disclose your mobile number to our messaging service provider only so far as is necessary to deliver messages to you, under a contract that prohibits any other use.
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Buff Bo Outfitters. Your participation in this program is completely voluntary.
We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.
You may opt-out of the Service at any time. You may reply STOP to +1 (866) 283-6055, or use any other reasonable method that clearly expresses your wish to stop receiving messages, including replying with words such as STOP, END, QUIT, CANCEL, UNSUBSCRIBE, REVOKE or OPT OUT, clicking an unsubscribe link in any message, emailing us at elizabeth@buffbo.com, or telling our customer support team. You'll receive a one-time opt-out confirmation text message. We will act on your request as soon as practicable and in no event later than ten (10) business days after we receive it. No further messages will be sent to your mobile device, unless initiated by you. If you subscribed to more than one Buff Bo Outfitters mobile message program, we will treat your opt-out as applying to every promotional messaging program we operate, so you do not need to opt out of each one separately.
For Service support or assistance, text HELP to +18662836055 or email elizabeth@buffbo.com. If you text HELP, we will reply with the name of the program, our contact details, and instructions for opting out.
We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. We will continue to monitor any short code or telephone number we have retired for a reasonable period after the change, and we will honor any STOP, HELP or other opt-out request sent to it. You may also opt out at any time using any of the other methods described above.
The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
We respect your right to privacy. We will not sell, rent or disclose your mobile number, or your text messaging consent, to any third party for that party’s own marketing purposes.
